A wrongful death lawsuit has been filed in the case of a woman who was killed after an out-of-control SUV crashed into an H-E-B store in Houston. Media reports say that the woman’s husband filed the lawsuit three days after the fatal Houston car crash, seeking over $1 million in damages.

“The husband of a woman who died when an out-of-control car crashed into a southeast Houston H-E-B store is asking for more than $1 million in a lawsuit that names the grocery chain along with the driver and another person who owns the sport utility vehicle.”

Two other people, including a two-year-old infant, also reportedly sustained non-fatal injuries in the crash. Police say the driver of the vehicle, who is a named defendant in the lawsuit, was backing out of a handicapped parking spot close to the exit of the store and subsequently picked up speed prior to crashing into the building. The impact knocked down a heavy concrete sphere that had been erected at the front of the store for the prevention of these types of incidents.

The lawsuit accuses the driver of being negligent by failing to take necessary evasive action and not braking in time to avoid harming the victims.

Reasons to Avoid Delaying Legal Action in a Houston Personal Injury Case

Houston personal injury lawyer Amy Witherite of Eberstein Witherite, who is not connected to the lawsuit, says the case is one that helps highlight reasons attorneys stress the importance of taking swift legal action in such matters. Says Witherite “For Houston car accident victims and their families prompt legal action is warranted for several reasons, namely so that the process of getting financial damages owed to victims is not hindered.”

The Houston lawyer says that for victims who have a valid basis for filing a legal claim of negligence in a personal injury case, the following are key reasons to avoid delays in taking steps to seek legal compensation:

  • Evidence needs to be preserved – According to Witherite, delaying the process of seeking support for filing a car accident injury claim, whether or not a fatality has occurred, can be risky when it comes to ensuring that evidence is preserved. Says the Houston attorney “aside from a police investigation, it is often necessary in any type of serious accident case that an independent investigation be sanctioned by the attorney handling a case so that all evidence supporting one’s claim is uncovered.”
  • Injured survivors typically cannot afford needed medical care out of pocket – Law firms like Witherite’s have the resources to help ensure that injured victims have access to proper medical treatment while their case is being handled if they cannot afford it out of pocket if steps are taken quickly to obtain this support.
  • Litigation can take time – The litigation process can be lengthy if one is seeking the fairest compensation possible for their case. Therefore, getting started with the process as soon as possible is important for avoiding unnecessary delays in getting an acceptable resolution.
